The compilation of all Content on our Services is the exclusive property of Technophilie and is protected by international copyright laws. All trademarks, service marks, and trade names used on our Services are the property of Technophilie or its affiliates, except as otherwise specified.
Limited License
We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use our Content for personal, non-commercial purposes. This license does not include any resale or commercial use of our Content; any collection and use of any product listings, descriptions, or prices; any derivative use of our Services or Content; or any use of data mining, robots, or similar data gathering and extraction tools.

12. Limitation of Liability
To the fullest extent permitted by applicable law, in no event will Technophilie, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use our Services;
- Any conduct or content of any third party on our Services;
- Any content obtained from our Services; and
- Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.
In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed, our liability shall be limited to the maximum extent permitted by law.

14. Termination
We may terminate or suspend your access to all or part of our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

16. Dispute Resolution
Mandatory Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in New York, New York before one arbitrator. The arbitration shall be administered by JAMS pursuant to its Comprehensive Arbitration Rules and Procedures.
Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between us and you individually. To the full extent permitted by law:
- No arbitration or proceeding shall be joined with any other;
- There is no right or authority for any dispute to be arbitrated or resolved on a class action basis or to utilize class action procedures; and
- There is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions
Notwithstanding the foregoing, either party may seek emergency equitable relief before a state or federal court to maintain the status quo pending arbitration. A request for interim measures shall not be deemed a waiver of the right to arbitrate.
17. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
18. Complete Agreement
These Terms, together with the Privacy Policy and any other legal notices published by us on our Services, shall constitute the entire agreement between you and us concerning our Services. These Terms supersede and replace any prior agreements or understandings, whether written or oral, regarding the Services.
